Judicial Reforms

Judicial Reforms refer to the improvement of an authentic and dedicated Judicial System including minimum facilities to Advocates as an officer of the Court. So that justice can be delivered fairly, transparently and without unnecessary delay. A strong and independent judiciary is one of the most important pillars of a democratic nation, and continuous reforms are essential to maintain public trust in the justice delivery system.

Judicial System
The judiciary is regarded as one of the most vital pillars of our democratic framework. It comprises not only the Hon’ble Judges but also Advocates, Court Staff, and various stakeholders from society, including litigants, who collectively form the judicial system.

Judicial reforms are essential for improving the roles and functioning of judges, advocates, clerks, court staff, litigants, and society at large. These reforms aim to ensure a more effective, transparent, and accessible justice delivery system.

Adhivakta Congress works towards strengthening the judicial system and promoting the welfare of advocates. It believes that advocates, being officers of the court, should be provided with the necessary minimum facilities in court premises to effectively perform their professional duties and assist in the administration of justice.

Key Features of Judicial Reforms
Judicial reforms aim to strengthen the justice delivery system by addressing the needs of all stakeholders—judiciary, advocates, court staff, and society at large.

1. Judicial Reforms for Judicial Systems

  • Reduction of Case Backlog through fast-track courts and better case management systems
  • Digitalization of Courts (e-filing, virtual hearings, case tracking systems)
  • Judicial Infrastructure Development (modern courtrooms, adequate facilities)
  • Timely Appointment of Judges to fill vacancies and improve efficiency
  • Transparency & Accountability in judicial processes
  • Use of Technology & AI for research, documentation, and case flow management
2. Judicial Reforms for Advocates and Their Families
Such Reforms may include better court chamber, organized and time-bound hearings, health insurance, pension and welfare schemes, financial assistance for advocates in distress, and support systems for their families such as childcare facilities and counselling services.
  • Social Security Measures (insurance, pension schemes, welfare funds)
  • Fair and Timely Fee Mechanisms
  • Professional Development Programs (training, skill enhancement, legal education)
  • Better Working Conditions (chambers, libraries, digital access)
  • Support Systems for Families in cases of hardship or emergencies
  • Recognition & Protection of Professional Rights
In addition, promoting continuous legal education, professional training, digital resources, and mentorship programmes for young advocates can enhance the efficiency and stability of the legal profession. Strengthening the welfare system for advocates, their clerks and their families will ultimately contribute to a more effective and humane justice delivery system.

These reforms aim to create a supportive legal environment where advocates can perform their professional duties effectively while maintaining the dignity, security and well-being of their families.

3. Judicial Reforms in Respect of Court Staff
Advocates/Court staff such as clerks, stenographers, peons and other administrative personnel play a vital role in the functioning of the judicial system. Judicial reforms should focus on improving their working conditions, infrastructure, training and welfare so that the justice delivery system becomes more efficient and organized.
  • Capacity Building & Training Programs
  • Improved Salary Structures and Service Conditions
  • Digital Skill Development for handling modern court systems
  • Efficient Work Allocation & Management Systems
  • Safe and Supportive Work Environment
  • Performance-based Incentives and Promotions
Reforms may include modern court infrastructure, better salary and service benefits, health insurance, pension schemes and regular training programmes to enhance their professional skills. The digitization of court records, e-filing systems and automated case management can significantly reduce administrative burdens and improve efficiency.

Special attention should also be given to advocates’ clerks, who assist advocates in filing, documentation and case management. Providing them with proper training, welfare benefits, professional recognition and access to modern technology will strengthen the overall functioning of courts.

Such reforms will help create a more efficient, accountable and well-supported judicial administrative system, ultimately improving the delivery of justice.

4. Judicial Reforms in Respect of Society
Judicial Reforms relating to society aim to ensure that the Judicial system is accessible, transparent, efficient and responsive to the needs of all citizens. The primary objective is to make justice available to every person, especially the poor, marginalised and disadvantaged sections of society.
  • Access to Justice for All (legal aid, affordable justice mechanisms)
  • Speedy Disposal of Cases to build public trust
  • Legal Awareness & Literacy Programs
  • Alternative Dispute Resolution (ADR) mechanisms like mediation and arbitration
  • Protection of Fundamental Rights and Civil Liberties
  • Inclusive Justice System ensuring equality irrespective of socio-economic background
Such reforms may include strengthening legal aid services, simplifying legal procedures, promoting legal awareness and improving transparency in the judicial system. The use of technology, digitisation of court processes, and alternative dispute resolution methods such as mediation and arbitration can also help reduce delays and improve access to justice.

Judicial reforms should also focus on protecting human rights, ensuring equality before the law, strengthening public trust in the judiciary and promoting social justice. Through legal awareness programmes, public participation and constructive dialogue, society can actively contribute to improving the justice delivery system.

These efforts ultimately help in building a fair, inclusive and rule-based society where justice is accessible to all.
